Agreement:
GENERAL:
Exotic Lines Travels. SARL, the company registered in Marrakech, Morocco, under R.C. N° 61509. Our Company is offering all in relation with tourism such as; Transportation, Organization, Activities, Tours, Accommodation, Foods and Attractions…
The service could be offered to a client (Tourist) or to intermediates (Person, Guide, Companies, OTAs, Hotels, Riad or residence…)
The agreement come into force and become legally binding for; (between the company and the client or between the company and the intermediate or between the clients and the intermediate if need) once the clients, the intermediate start to use our service.
Starting to use our services means the client or the intermediate shall be well-known to have accepted the terms of this agreement without any exceptions or reservations or borders not contained herein.
The company advises the users (client, intermediate) to review the agreement to ensure that the user accept the terms and conditions that apply when using our services, otherwise the company reserves the right.
DESCRIPTION OF SERVICE:
The client (Tourist or intermediate) can organize all our services proposed on our website only if they are over 18 years old, person who have not attained this age may not use the service independently but may participate in activities accompanied by adults.
INSTRUCTIONS:
The company bears no responsibility for:
- Any losses in the car or outside (café, restaurant or in other places… ) during one of services proposed by the company.
- The client shall fallow all consigns given by our guides or our drivers to avoid breaking the low, otherwise clients bears the consequences of any tickets.
PAYEMENTS:
The user/Client shall make a fall or partial prepayment of the cost of the service/Attractive via one the options offered by the company in consideration the customer agreement.
The user/client also agrees that the company has the right to add to the price any processing charges which are due to under the relevant agreements between the company and its books or payment system.
In case the service is cancelled the amount of processing charges shall not be refunded to the user.
After accepting the price and processing the payment of the service, the user/client has no right of counterclaim about payment.
The company uses the XE Exchange to convert all currencies.
CANCELLATION AND REFUND :
The service may be cancelled with the observance of the rules and deadlines any change by the user of the service conditions such as (the pickup time/location, the service route, number of passengers, vehicles etc… ) the company has the right to refuse/update to perform the service.
The company bears no responsibility in case the client agreed an order does not show up at an agreed place of the service at the pickup time within 60 minutes at the airport and port terminals, 30 minutes at the train station and bus station and 15 minutes at all other places.
The client has legal capacity under the laws applicable in Morocco and agrees to this agreement voluntarily, and that the client has full power authority and capacity to comply with this agreement and his obligations contained herein.
The clients have carefully and thoroughly read and understand this agreement.
The client represents and warrants that all information provided is true, complete, valid and not misleading in any respect and it acknowledges and agrees that the company enters into this agreement with him in reliance on the representations and warranties set out in the clause.
LIMITATIONS OF THE COMPANY’S LIABILITY:
EXOTIC LINES TRAVELS is a tour operator and a transportation company; so when the user choose one of services that include failures so the company recommend restaurant, cafes, shops and hotels so the company bears no responsibility in case a miss of quality and accept only immediate complains. Any of complains or claims of a client after leaving Morocco is not accepted and cannot be taken into account.
EXOTIC LINES TRAVELS shall not be held liable for circumstances beyond our control, such as weather, road and traffic conditions, any decisions of local authorities or mechanical breakdowns.
To the fullest extent permitted by law, the company expressly disclaims all liability for any loss what so ever, and how so ever caused in cured or suffered by the client or anyone else, and including any loss arising from or in connection with:
- In all our vehicles during one of services ( transfer, day trip or multiday trips …)
- In all attraction or places for food during one of our services ( transfer, day trip or multiday trips …)
- In all hotels proposed by the company for accommodation during multiday trips…
No Show:
In the event that the Driver arrives on-site and the Passenger does not show, the full fare is charged without a refund. Our Driver will wait no less than 60 minutes for airport after the flight landing or 15 minutes for other locations and will make repeated attempts to contact the Passenger, in the event they cannot be located.
If the passenger fails to be at the designated pickup location (no-show). If for any reason you cannot locate your chauffeur, please contact us. To avoid being billed as a no-show, do not leave your location without contacting us by phone.
Smoking / Food:
No smoking or food of any kind is allowed in the vehicles. Any damages from smoking or food will be charged a 500.00 MAD cleaning fee. In the event of smoking or food, the chauffeur reserves the right to cancel the run with no refund.
Unforeseen Event:
The client understands and accepts that Acts of God, unforeseen traffic, road conditions and/or severe weather conditions or any decisions of local authorities delay travel. Every effort will be made to dispatch the contracted vehicle (s) during these conditions and all attempts will be made to arrive at the designated pick up locations on time. In the event that there is a delay caused by an Act of God, unforeseen traffic, road conditions and/or severe weather conditions or any decisions of local authorities resulting in any of the contracted vehicle (s) arriving late at any of the pick up addresses, we will modify the drop off time to reflect the amount of time caused by the delay. You agree that this action will compensate you for the delay and there will be no further liability to us. Should we deem at any time up until the day of the service that said conditions are too dangerous for our chauffeurs and/or vehicle(s) than we will inform you of such and terminate the service.
EXOTIC LINES TRAVELS assumes no responsibility and shall not be held liable for any damages, personal injuries, or physical harm incurred as a result of getting in/out of the vehicles, inappropriate behavior within the vehicles by the client and/or guests
EXOTIC LINES TRAVELS assumes no responsibility and shall not be held liable for lost or damaged personal belongings and/or items left in the vehicles by the client and/or guests
In the event that you refuse to pay your obligations resulting in EXOTIC LINES TRAVELS needing to employ a collection company or an attorney, you agree to fully reimburse EXOTIC LINES TRAVELS all attorney fees, court costs, collection fees and any out of pocket expenses that we may incur. A 5% monthly charge will be added to all unpaid balances.
Warm/Hot weather days may affect the cooling ability of the vehicle in which EXOTIC LINES TRAVELS is not responsible for. In the event that the rented vehicle suffers or sustains a mechanical problem, we may provide a vehicle of similar kind and quality at our discretion.
Any damages to the interior and/or exterior of the vehicle will be the responsibility of the client. If there is any items/property belonging to EXOTIC LINES TRAVELS damaged/removed by any passenger, it will be the responsibility of the client to pay for the repairs. There is an additional charge of 500.00 MAD for cleaning the vehicle, if a person becomes sick or if there is any damage or excessive cleaning from any passenger, it will be the responsibility of the client to pay for the repairs, depending on the severity of the damage. Damage costs will be determined by EXOTIC LINES TRAVELS after appropriate professional quotes are obtained.
